General Terms and Conditions and Rental Conditions
1. Scope of Application
These General Terms and Conditions apply to all accommodation contracts concluded between Florian Reyes (hereinafter referred to as the "Landlord") and the guest (hereinafter referred to as the "Tenant") via the website or the booking system.
2. Booking and Conclusion of Contract
2.1. By making an electronic booking, the Tenant submits a binding offer to the Landlord to conclude an accommodation contract.
2.2. The contract only comes into effect upon the Landlord's booking confirmation (via email).
2.3. The booking is made for the specified number of persons. Overoccupancy entitles the Landlord to terminate the contract immediately or to charge an additional fee.
3. Prices and Payment Terms
3.1. The prices displayed at the time of booking shall apply.
3.2. After conclusion of the contract, a deposit amounting to 20% of the total price must be paid within 7 days.
3.3. The remaining balance is due no later than 14 days prior to arrival. For short-term bookings, the total price is due immediately.
3.4. If payments are not made in due time, the Landlord reserves the right to withdraw from the contract and demand cancellation fees in accordance with Section 4.
4. Cancellation and Withdrawal
The Tenant may withdraw from the contract at any time prior to the start of the trip. The withdrawal must be submitted in writing (via email). In the event of a withdrawal, the following cancellation fees shall apply:
- Up to 30 days before arrival: Free cancellation.
- Up to 14 days before arrival: 50% of the rental price.
- Up to 7 days or less before arrival, or in the event of non-arrival: 100% of the rental price.
We strongly recommend purchasing travel cancellation insurance.
5. Arrival and Departure
5.1. The holiday apartment will be available from 14:00 on the day of arrival.
5.2. On the day of departure, the apartment must be vacated in a swept-clean condition by 11:00 at the latest.
6. Obligations of the Tenant & House Rules
6.1. The Tenant undertakes to treat the rented property and the inventory with care.
6.2. Any damage occurring during the rental period must be reported to the Landlord immediately. The Tenant is liable for any damage caused by them.
6.3. Smoking is prohibited inside the building.
6.4. Pets are prohibited.
6.5. Parties and loud events are prohibited out of consideration for the neighbors. Quiet hours from 22:00 to 08:00 must be observed.
7. Liability of the Landlord
The Landlord is liable within the scope of the duty of care for the proper provision of the rental property. Liability for occasional outages or disruptions in the water or electricity supply, as well as the internet connection, is excluded, provided these are not due to gross negligence on the part of the Landlord.
8. Choice of Law and Jurisdiction
8.1. Spanish law shall apply.
8.2. The place of jurisdiction for all disputes arising from the rental relationship is the location of the property (Tenerife, Spain), to the extent legally permissible.
